Direct observation. Yes, like the military.
Routine drug screens (random, pre-employment, post-accident) use unobserved urine collection — driver provides the sample privately. RTD and follow-up tests are different. FMCSA requires a same-sex collector to physically observe the sample being provided, per 49 CFR 40.67. Same procedure used by the Department of Defense for service-member testing. Most drivers don't know this until they walk into the clinic — the surprise is harder than just being told.
Why it's required
RTD is the gate back to safety-sensitive work after a violation. The integrity of this specific sample matters more than a routine screen — there's a recorded reason for tampering risk. FMCSA closes that loophole with mandatory observation. 49 CFR 40.67(a).
Who observes
A trained same-sex (gender-matched) collector employed by the clinic. They observe the act of providing the sample. They don't retain or share what they observed — it's a procedural step, not a record. If a same-sex collector isn't available at a given clinic, we route to a different network site.
Why $30 extra
The lab charges an additional collection fee for the observer's time. We pass it through at cost — no markup. Total observed RTD test: $69 + $30 = $99. Every follow-up test in your 12-month (and possibly longer) post-RTD period is also observed at the same $99.

FMCSA prescribes a specific sequence — a Substance Abuse Professional evaluates and clears, an observed RTD test gates the return, and follow-up testing continues for at least 12 months. We can't shorten the SAP timeline, but we own everything else.
SAP evaluation + treatment
A DOT-qualified Substance Abuse Professional evaluates the driver, prescribes the treatment or education plan, and after completion confirms the driver is ready for the RTD test. Most drivers complete this in 4–6 weeks; some take longer depending on the SAP's plan.
Observed RTD drug test
Once the SAP authorizes, the directly-observed RTD test is scheduled. Negative result clears the driver to return to safety-sensitive duty. Positive or refusal restarts the entire SAP process — there is no shortcut. 49 CFR 40.305.
6+ follow-ups + Clearinghouse
Minimum 6 unannounced observed tests in the first 12 months back on duty. SAP can extend to 60 months. Negative RTD and completion of follow-up plan are reported to the FMCSA Clearinghouse, removing the prohibited-from-duty status.

Any of these violations under 49 CFR Part 382 puts a driver into the RTD process. Different paths in — same observed test on the way out.
Positive drug test
Verified positive on any DOT drug test (random, pre-employment, post-accident, reasonable suspicion). Driver removed from safety-sensitive duty until SAP completion + RTD test.
Positive alcohol test
BAC of 0.04 or higher on any DOT alcohol test. Same SAP process applies. BAC of 0.02–0.039 doesn't trigger RTD but does require 24-hour removal from duty.
Test refusal
Failure to appear, leaving the collection site, refusing to submit a sample, refusing the observation, or providing an adulterated/substituted sample — all treated as positive results.
Actual knowledge
Employer's actual knowledge of prohibited use (admission, on-duty observation, citation for DUI on duty) — same SAP process. Also: missed follow-up test during the post-RTD period restarts the process.

A same-sex collector physically observes the urine sample being provided. This isn't a Vertical Identity policy or an upcharge tactic — it's federal regulation, identical to how the Department of Defense conducts service-member testing.
How much does the return-to-duty test cost?
The base DOT 5-panel drug test is $69 at member rates. The federally-required direct-observation surcharge is an additional $30, for a total of $99 per observed RTD test. The observation fee covers the additional collector time. All follow-up tests after RTD are also observed and run the same $99 each. Breath alcohol tests are $59 if the SAP requires them. We pass the lab's observation fee through at cost.
How long does the return-to-duty process take?
It varies by SAP recommendation. At minimum: initial SAP evaluation, completion of any prescribed education or treatment, follow-up SAP evaluation, then the observed RTD test. Some drivers complete the process in 4 to 6 weeks. Others take several months depending on the SAP's plan. We can't shorten the SAP's timeline, but we can move fast on the testing side once you're cleared.
Who watches during the observed collection?

What if I refuse the observation?
Refusal of an observed collection counts as a refusal to test under 49 CFR 40.191. A test refusal is treated identically to a positive result — meaning the driver remains disqualified from safety-sensitive duty and the SAP RTD process restarts. There is no path to return to duty without completing the observed test.
What follow-up testing is required after a passing RTD test?
The SAP determines the follow-up schedule. The minimum required by FMCSA is 6 unannounced follow-up tests in the first 12 months back on duty. The SAP may extend this for up to 60 months total. Every follow-up test is also observed (same $99/test) — the observation requirement applies to the entire follow-up period, not just the initial RTD.
